Copyright Policy
The Tallenge Store takes copyrights and intellectual property rights very seriously. Our platform was built to create a community for artists to showcase and sell their work. In doing so, we expect your uploads to conform to certain conditions: that they are your own work or you have permission from the rightful owner to use/reuse work, contain original ideas and do not infringe on intellectual, moral or publicity rights of any other individual or organization.

Reporting Infringement
We at The Tallenge Store respect the intellectual property rights and expect the same of our users. However, as The Tallenge Store is a platform where anyone can create an account and upload their work, it is impossible for us to actively monitor every artwork uploaded onto our website.
If you notice any work that infringes upon your rights, please do bring it to our notice. This can be done by emailing us at support@tallenge.com with subject as “Copyright Infringement”. In order to deal with such violations, we are required to authenticate the requests and hence, we advise you to provide the following information along with the reporting of infringement-- A description of the matter claimed to have been infringed.
- A description of where the claimed infringing content is located on The Tallenge Store site (provide the URL)
- Your address, mobile/phone number, and email address.
- An electronic or physical signature of the owner of the work or of the person authorized to act on behalf of the owner of the relevant matter.
The offending works will be taken down immediately if the claim is deemed valid. Additionally, Tallenge store may suspend or terminate user accounts based on the severity of the offence.

Takedown Notice
If you receive a mail from The Tallenge Store team regarding one or more of your artworks being taken down due to a report of infringement, you will have an option to respond to such a notice.
The infringement report that has been received may or may not have also included other works by other artists, and by removing the work, we are not stating that your work does or does not infringe copyright, trademark or publicity rights law.
We have a legal obligation to act on reports filed in accordance with our Copyright Policy.
While the work may not have been a direct copy of someone else's work, it may contain elements, logos, or personal likenesses, which may infringe on another's rights.
If you believe a report was in error or should not apply to your work, you have the right to lodge a counter-notification.
We do apologize that we are legally not able to provide individual copyright, trademark or publicity rights advice, or give personal opinions on these matters. It is our recommendation that you do sufficient research regarding the relevant copyright, trademark and IP laws and their application to your work on the Internet or consult with an Intellectual Property Rights specialist if you are unsure why your specific work may have been included in an infringement report. -
Countering an Infringement Report
If you believe that removal of the content is the result of a mistake (for example, that you have authorization to use/sell the work) or misidentification, you can send us a counter notice via store@tallenge.com. Such counter notice must provide the following information-
- A description of the content, which we have removed, including the URL on which the content was located on The Tallenge Store site.
- Your address, mobile/phone number, and email address.
- An electronic or physical signature of the owner of the work or of the person authorized to act on behalf of the owner of the relevant matter.
- A statement by you that, under penalty of perjury, you have in good faith a belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
If we receive your counter notice, but your work does not comply with the Tallenge Store User and Services Agreement and/or our Copyright Policy, we may inform you that we are not able to reinstate your work. We may also request further information from you in order to determine whether the work can be reinstated.
In many circumstances, however, we will forward your counter notice directly to the complainant, which will include your personal contact information. At that time the complainant may take legal court action against you in. If after 14 days the complainant has not taken legal action against you, you may contact us to request that we reinstate your work. If your work otherwise complies with our Terms and Copyright Policy, we may reinstate your work at that time.
